The Waqf (Amendment ) Bill 2024

 The Waqf (Amendment) Bill, 2024 introduced in the Lok Sabha on August 8, 2024 , seeks amend the Waqf Act, 1995, which is an endowment of movable or immovable pious, religious, or charitable under Muslim Law.


Key point amendments of Bill :

1. Inclusion of Non- Muslim Members :

The bill mandates the inclusion of at least two non- Muslim members in both the Central Waqf Council and state Waqf Boards, which were previously composed exclusively of Muslims.

2.Disputed properties

It grants the govt authority to determine ownership of disputed waqf properties,a role traditionally managed by waqf boards.

3. Appointment procedures : 

The bill proposes removing elections for Waqf Boards , allowing state govt full control over appointing members and the chief executive officer ( CEO) , and eliminating the requirment that the CEO be Muslim.

4. Audit provisions :

It empowers the Central Govt to direct audits of any waqf at any time by an auditor appointed by the CAG or by an officer designated by the Central Government.

Concerns and Opposition :

Critics ,including opposition parties and Muslim organizations, argue that the bill infringes upon the constitutional rights of Muslims and could lead to the seizure of historically significant religious properties lacking formal documentation. They contend that the inclusion of non- Muslim members and increased govt control undermine the autonomy of waqf institutions.
